Booking Terms & Conditions
The Company enters into a contract with the passenger upon the following terms and conditions set out for and on behalf of itself, its employees, agents and subcontractors.
Passengers carried on O’Callaghan Coach Holidays are subject to the following terms and conditions:
1.Payment:
Deposit Payments: A non-refundable deposit of 50% per person is required for all coach tours and 50% per person for overnight trips. Full payment is required 6 weeks prior to departure to ensure reservations.
Credit Card Payments: We accept most major credit cards and laser cards. You must provide us with the cardholder’s information, including billing address and detailed credit card information to make a credit card payment by phone.
Final Payments: Full payment must be made no later than 6 weeks prior to departure date for all coach tours. O’Callaghan Coach Holidays accepts payment by major credit cards or Electronic Bank Transfer. If payment is not received as scheduled, your reservation will automatically cancel and you will forfeit your deposit payment.
Refunds: Refund values are at the discretion of management.
Refunds may only be obtained by writing to the Customer Service Manager, O’Callaghan Coach Holidays, Rockfield, Tralee Road, Killarney, Co. Kerry. There is no refund available for late cancellations.
In the event of any failure by the company to fulfill its obligations due to a circumstance beyond its reasonable control, the passenger shall be entitled to a refund of the tour cost but the company shall have no additional liability beyond this.
E-Tickets and Special Offers: Refunds are not available on e-Tickets or on tickets issued in conjunction with promotions or special offers unless specified.
2.Travel Insurance
O’Callaghan Coach Holidays recommends that all consumers take out travel insurance for both domestic and international holidays. Travel insurance is available from most travel agents. O’Callaghan Coach Holidays will not be responsible for any claims made against the insurance policies.
3.Luggage
It is the responsibility of each passenger to present personally their luggage for customs and/or security examination when required.
All luggage must be labelled and is carried at owner’s risk. Medication, money, travel/identity documents and other valuable items must not be carried in luggage but should be carried on the person at all times. Hand luggage must not be left unaccompanied in the coach during the ferry crossing or at refreshment stops. Additional luggage including bulky or heavy items will not be carried due to weight and space restrictions.
The company is not obliged to carry any of the following items of luggage and passengers may not bring them onto any coach – any weapons, drugs or solvents (other than medicines), live or dead animals, fish or insects, prams, non-folding pushchairs, bicycles, skis and surfboards.
The company does not accept liability for loss or damage to the passenger’s luggage or to any possessions of the passenger (however caused), unless such loss or damage is proven to have been caused by the negligence, breach of duty or breach of statutory duty of the company. In the event of the company being proven liable for
loss or damage under this clause the liability shall be limited.
4. General Terms
Passengers are not permitted to:
• smoke in or on any part of a vehicle operated by the company
• bring on to the company’s vehicles or have in their possession when on them, intoxicating liquor for the purpose of consuming the same
• consume intoxicating liquor on the company’s vehicles
• enter or remain upon the company’s vehicles having consumed intoxicating liquor or when drunk
• bring on to the company’s vehicles or have in their possession when on them any medicinal products other than for medicinal purposes within the meaning of the Misuse of Drugs Act 1977
• remain on a vehicle when directed to leave by the driver or other company official on the grounds that he or she is causing a nuisance.
The company reserves the right to refuse entry to or to remove from the company’s vehicles any passenger who shall be or, in the opinion of the driver or other company official appears to be, in breach of any of the provisions and any passenger so refused or removed shall not be entitled to any refund or compensation from the company and the company shall have no liability to the passenger whatsoever.
5. Passenger Responsibilities
All passengers should aim to arrive at the boarding point for their coach 15 minutes prior to the scheduled departure time. Where passengers arrive later than the scheduled departure time, the company reserve the right to allow passengers without reserved tickets to board the coach. No responsibility for any loss can be accepted in such circumstances.
6. Comfort Breaks
Short comfort stops are made on some routes for refreshments. Passengers must return to the coach punctually within the time allowed for these halts. Coaches may have to proceed without a passenger who fails to rejoin the coach at the prescribed time as set out in the timetable or as prescribed by the driver. The company will not be liable for any loss or damage caused by such an occurrence.
7. Disabled Persons
It shall be the consumer’s responsibility to disclose to O’Callaghan Coach Holidays any physical or mental condition of a member of his party which may be relevant. O’Callaghan Coach Holidays reserves the right to decline to provide a holiday for a disabled person where it is our option that holiday would be inconsistent with the special needs of a disabled person.
8. Safety
All passengers must remain seated in the interest of safety whilst vehicles are in motion. Seatbelts where fitted must be worn. Movement to the contrary is at passenger’s own risk. At no time may drinking alcohol or smoking be permitted on any coach or other transport provided. O’Callaghan Coach Holidays and their agents reserve the right to refuse passage to any persons who are found in violation of these
safety conditions, or who are found to be a danger to themselves or any other passengers. These persons forfeit any claim for compensation
or refund.
9. Failure of Ferry Service to Operate
Passengers should note that in the event of a disruption to ferry services, for any reason whatsoever, O’Callaghan Coach Holidays will not be liable for alternative travel arrangements, accommodation and/or other costs incurred by passengers. However, every effort will be made to facilitate passengers on the earliest available departure after such disruptions.
10. Attractions, Entertainment and Other
O’Callaghan Coach Holidays reserve the right to substitute visits, entertainment and other features when establishments are closed or cannot be visited for reasons beyond our control.
